Data protection

Data protection declaration

We, the company Rausch GmbH, thank you for visiting our website and your interest in our company and our services. The protection of your privacy during processing is important to us. Therefore, your personal data will only be processed in accordance with the provisions of German and European data protection law. We want you to feel safe when visiting our website.

Introduction

With this data protection declaration, we comply with the information obligations we have towards our visitors and users of these pages in accordance with Article 13 of the EU General Data Protection Regulation (EU-GDPR). Protecting personal data is of central importance to us. Personal data is individual information about personal or factual circumstances of a specific or identifiable natural person. This includes information such as name, address, e-mail and telephone number. In addition to the EU GDPR, the legal basis for data protection can also be found in the German Telemedia Act (TMG) and the EU ePrivacy Regulation.

Your rights in the area of data protection as a user of this website (rights of data subjects)

Data protection law sees you as the person affected by the data we collect about you when you visit our website. Accordingly, the legislator provides for some of the data subject rights you have as a user of this website. Specifically, these are the following rights:

You have the right to free information about your stored personal data, its origin and recipient and the data processing purpose at any time - without giving reasons. You also have the right to rectifying, correcting, blocking or deleting this data. You can also restrict the processing of your data and/or object to the processing (right to object), and you also have the right to data portability. If you have given us your consent to process your data, you can revoke this at any time. You also have the right to lodge a complaint with the supervisory authority in accordance with Art. 77 EU GDPR.

Contact data: Controller - data protection coordinators - data protection officer

If you have any questions about data protection at Rausch GmbH that are not answered by this data protection declaration or if you want to implement your data subject rights, you have the following contact options:

The management indicated in the imprint is responsible for data processing. However, inasmuch as this deals with many other topics, we recommend that you email our data protection coordinators ([email protected]). You can also use the postal service, the address can also be found in the imprint.
In addition, Rausch GmbH has appointed an external data protection officer. You can also reach him at: [email protected]
Or at: BoConos GmbH, Weiherstraße 43, 72663 Großbettlingen

We would like to point out that you can ask any of our employees about your rights as a data subject. However, it is a great relief for us if you contact our data protection coordinators ([email protected]) directly with data protection inquiries.

If you wish to use the right of appeal under Art. 77 EU-DSGVO, please contact the responsible supervisory authority.

Recipients of personal data

If you transmit personal data to us, the main recipients are the employees assigned by Rausch GmbH ++. In addition, it is possible that we commission other companies and individuals to perform tasks for us, e.g. services that you have requested from us using the contact request (e.g. a printed product brochure). In this case, your data may be processed by the company commissioned by us for the purpose specified by you. More information can also be found in the sections “Obligations of employees and external service providers” and “Cooperation with external service providers.”

Transfer of personal data to a third country

We do not intend to transfer personal data beyond the scope of the EU GDPR. Inasmuch as we occasionally obtain web services from Google (e.g. we use "fonts.gstatic.com" for graphic design of typefaces), IP addresses, so-called "referral links" or online identifiers, for example, can be passed on depending on the browser settings. Due to the combination of this data, which we did not arrange, it cannot be ruled out that personal data will be created and processed outside the scope of the EU GDPR. You can prevent the transfer in your browser, for which you can find more information in the section "Use of Google Maps."

Storage duration

Personal data that has been communicated to us via our website will only be stored until the purpose for which it was entrusted to us has been fulfilled. Insofar as commercial and tax law retention periods have to be observed, the storage period for certain data can be up to ten years.

Purpose of data collection

Our site can usually be used without providing any personal data. There may be different regulations for using individual services on our site, which in this case are explained separately below and inform you in particular about the type, scope and purpose of collecting, using and processing personal data. Nevertheless, we only process personal data to the extent that it is necessary to provide a functioning website and our content and services. Should there be a collection of personal data, then the purpose is the technical provision of our website, for information and contractual purposes in providing services. Any use of your personal data is only for the stated purposes and to the extent necessary to achieve these purposes.

If you apply to us via the website, the purpose of the data processing is the possible initiation of an employment relationship.

Legal basis for data collection

Personal data may only be processed on a legal basis. If we process personal data in the context of our website, then usually based on safeguarding the legitimate interests of the person responsible according to Article 6 Paragraph 1 lit. f EU-DSGVO.

Protecting legitimate interests is a balancing of interests and includes both our interests as the company responsible for processing and the interests of our website users. We as a company would like to inform you about our company and its products and services. As a user and potential customer, supplier, competitor, information seeker and/or applicant, you have an interest in finding out about us, our services and products in a technically accessible and convenient manner. In addition, we give our visitors the opportunity to contact us via the website. Accordingly, processing is in the interests of both parties. At the same time, processing personal data is reduced to a minimum, so we come to the conclusion that protecting legitimate interests is the legally sufficient basis for processing.

As part of the application process, we use the legal basis of the contract and the initiation of a contract (Art. 6 Para. 1 lit. b EU-DSGVO), in particular § 26 BDSG-new (data processing for purposes of the employment relationship). You can find more information on this in the “Applications” section.

In addition, we use the legal basis of consent in the context of the application process (Art. 6 Para. 1 lit. a EU-DSGVO). This consent is voluntary and serves the purpose of personnel recruitment and transferring your data to an internal talent pool. You can find more information on this in the “Applications” section. You are free to decide whether you want to give your consent or not. There are no negative consequences if you do not give your consent. You can also revoke your consent in whole or in part at any time for the future. The lawfulness of processing based on consent remains in effect until it is revoked. This means that despite the consent revocation, processing has not become unlawful in the past.

Cookies

Our website uses so-called cookies, which serve to make our website more user-friendly, effective and secure overall - for example when it comes to accelerating navigation on our website. In addition, cookies enable us to measure, for example, the frequency of page views and the generic use of the websites.
Cookies are small text files stored on your computer system. Cookies do not damage your computer and do not contain viruses. We would like to point out that some of these cookies are transferred from our server to your computer system, most of which are so-called "session cookies." "Session cookies" are characterized by the fact that they are automatically deleted from your hard drive after the end of the browser session. Other cookies remain on your computer system and enable us to recognize your computer system on your next visit (so-called permanent cookies). You can of course refuse cookies at any time, provided your browser allows this. However, we would like to point out that in this case you will not be able to use all the functions of our website to their full extent.

The help function in the menu bar of most web browsers explains how to prevent your browser from accepting new cookies, how to let your browser know when you receive a new cookie or how to switch off all cookies received.

Of course, you can also delete cookies afterwards. The procedure depends on the browser and operating system. We ask you to research the procedure for subsequent deletion for your system yourself.

Server log

Every visit to the pages of this website is recorded and stored in the so-called server log files. This data is used exclusively for technical analysis of server usage.

Specifically, the following data is collected:

Requesting host address (IP address)
Date and time of retrieval
Name of retrieved file
HTTP status code
Amount of data transferred
Website from which you visit us (referrer URL)
Browser/operating system/interface
Information about the server service used
Protocol version
This anonymous data is stored separately from any personal data you may have provided and does not allow any conclusions to be drawn about a specific person. They will only be passed on to third parties if required by law or if a court decision orders them to be transferred. A transfer for commercial or non-commercial purposes does not take place. However, we reserve the right to subsequently check this data if we become aware of specific indications of illegal use.

Contact option

On our website we offer you the opportunity to contact us by e-mail and contact forms. Your details from the inquiry form, including the contact data you provided there for the purpose of processing the inquiry and in the event of follow-up questions, will then be forwarded to us in encrypted form and stored by us.

If you wish to contact us by e-mail, we would like to point out that the confidentiality of the information transmitted cannot be guaranteed in the case of unencrypted e-mails. The content of unencrypted e-mails can be viewed by third parties (see also the "Information security" section).

Applications

Applicant data is stored for up to six months after the end of the selection process.
In addition, if you send us an application, we ask that we may transfer your data to an internal talent pool. You then agree that we may process your data for a further two years for the purpose of personnel recruitment. This applies in the event that you are an interesting candidate for us in principle, but did not get a chance for the position for which you applied.

Use of Google Web Services and Google Maps

This website uses the "Google Maps" component to display maps operated by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043 USA, hereinafter "Google."
Each time the "Google Maps" component is called up, Google sets a cookie (this is a so-called "third-party cookie") in order to save user settings and data when the page on which the "Google Maps" component is integrated is displayed to process. This cookie from the third-party provider "Google" is usually not deleted by closing the browser, but expires after a certain period of time unless you delete it manually beforehand.

If you do not agree to this processing of your data, you have the option of deactivating the "Google Maps" service and thereby preventing the transmission of data to Google. You have several options for this: You can install suitable browser extensions (such as uMatrix or Disconnect, as of 04/25/2018) and instruct them to prevent the transmission to Google. You can also deactivate the Java Script function in your browser. However, we would like to point out that in this case you will not be able to use “Google Maps” and possibly other parts of our website, or only to a limited extent.

The use of "Google Maps" and the information obtained via "Google Maps" takes place in accordance with the Google Terms of Use http://www.google.de/intl/de/policies/terms/regional.html and the additional terms and conditions for "Google Maps" https://www.google.com/intl/de_de/help/terms_maps.html.

Like many other websites and service providers on the Internet, we use technical web services from Google. It can be assumed that Google collects and links the data that e.g. their cookies generate (such as online identifiers and IP address). In combination with unique identifiers and other information received by Google servers, Google can also create profiles of this website’s users and enhance existing profiles.

Google Analytics

We also use Google Analytics, a web analytics service provided by Google Inc. (1600 Amphitheater Parkway, Mountain View, CA 94043, USA; "Google"). Google Analytics also uses cookies, which enable an analysis of your use of our websites and online services. The information generated by the cookie about your use of this website and online offers is transmitted to a Google server in the USA and stored. We use Google Analytics with the "_anonymizeIp()" extension, so that IP addresses transmitted to Google are shortened and processed beforehand on servers in Europe in order to rule out direct personal reference. Google will use this information to evaluate your visit to the website, compile reports on website activity for us and provide other services related to website activity and internet usage. Google may also transfer this information to third parties if required to do so by law or if third parties process this data on behalf of Google. Under no circumstances will Google associate your IP address with other Google data. You can also prevent installing cookies for Google Analytics by setting your browser software; we would like to point out that in this case you may not be able to use all of our functions to their full extent. You can object to collecting and storing data for Google Analytics at any time with effect for the future using a Google browser plugin.

If you visit our site via a mobile device (e.g. smartphone or tablet), you can use this link to object to using Google Analytics for the future. By activating the link, we set a cookie in your browser, which signals us to prevent the use of Google Analytics for your end device. Please note that you must object again if you remove the cookies in your browser.

Google APIs

Our website uses Google APIs from Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (hereinafter: Google). This is a program interface provided by Google. As part of the use, data, such as the IP address in particular, can be transmitted to Google. You can prevent collecting and forwarding personal data (in particular your IP address) to Google and processing this data by Google by deactivating the execution of Java Script in your browser or by installing a tool such as 'NoScript.'

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on our websites. The provider is Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA ("Google"). The purpose of reCAPTCHA is to check whether data is entered on our website (e.g. in a contact form) by a human or an automated program. To do this, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, how long the website visitor spends on the website or mouse movements made by the user). Data collected during the analysis are forwarded to Google. reCAPTCHA analyses run completely in the background. Website visitors are not informed that an analysis is taking place. Data processing takes place on the basis of Article 6 Paragraph 1 Letter f GDPR. The website operator has a legitimate interest in protecting its web offerings from abusive automated spying and from SPAM. For more information about Google reCAPTCHA and Google's privacy policy, see the following links:

Use and disclosure of personal data

If you commission us to provide a service, your personal data will only be used to the extent necessary for the performance of the order (e.g. to process information requests or order brochures). This includes in particular transferring your data to transport companies, credit companies or other services used to provide the service or to process the contract.

Any further transfer, in particular a sale of your personal data to third parties, does not take place.

There are the following exceptions to this procedure: We disclose customer accounts and personal data about customers if we are legally obliged to do so, if such disclosure is necessary or to protect our rights and the rights of our customers and those of third parties, e.g. in the event of attacks on our network infrastructure. This may include, for example, data exchange with companies that specialize in preventing and minimizing misuse and credit card fraud and/or IT security. It is expressly made clear that in this context there is no transfer of data to these companies for commercial use that conflicts with this data protection declaration.

Obligations of employees and external service providers

Of course, our employees and the service companies commissioned by us are obliged to maintain confidentiality and to comply with the provisions of the EU GDPR.

Cooperation with external service providers

We engage other companies and individuals to perform tasks for us. Examples include delivering parcels, sending letters or e-mails, analyzing our databases, providing IT services, using advertising measures, processing payments and offering customer service. These service providers have access to personal information needed to perform their jobs. However, you may not use them for other purposes. In addition, they are obliged to treat the information in accordance with this data protection declaration and the EU GDPR.

If these subcontractors are processors in accordance with Art. 28 EU-DSGVO, we have concluded corresponding legally compliant contracts with them.

YouTube

Our website uses plugins from the Google-operated YouTube site. The site operator is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. If you visit one of our pages equipped with a YouTube plugin, a connection to the YouTube servers will be established. The YouTube server is informed which of our pages you have visited.
If you are logged into your YouTube account, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

YouTube is used in the interest of an attractive presentation of our online offers. This represents a legitimate interest within the meaning of Article 6 (1) (f) GDPR. Further information on handling user data can be found in YouTube's data protection declaration at: https://www.google.de/intl/de/policies/privacy

Information security

Rausch GmbH uses appropriate technical and organizational security measures according to the current state of knowledge in order to protect the data you have made available to us from accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Your data is stored in a secure operating environment that is not accessible to the public. Our security measures are checked at regular intervals and continuously improved in line with technological developments.

If you wish to contact us by e-mail, we would like to point out that the confidentiality of the information transmitted cannot be guaranteed in the case of unencrypted e-mails. Content of unencrypted e-mails can be viewed by third parties. We therefore recommend that you send us confidential information either in encrypted form or by post.

Your e-mail address will only be used for correspondence with you. Any other use or transfer to third parties does not take place.

Protecting your data by TLS or SSL

For secure data transmission on the Internet, we use the hybrid encryption protocol Transport Layer Security (TLS, German Transport Layer Security), more widely known under the previous name Secure Sockets Layer Software (SSL). This software encrypts the information you transmit. All information relevant to data protection is stored in encrypted form in a protected database.

Consent, status and changes to this data protection declaration

By using our website, you agree to the data processing described above. Current status is 05/22/2018.

We reserve the right to change this data protection declaration at any time with effect for the future in compliance with the applicable data protection regulations. The changes will be published here.
